Sections 28(2) and (3) of the Personal Data (Privacy) Ordinance provide that a fee may be charged for complying with a data access request made under section 18(1)(a) or (b), which fee shall not be excessive. Hence, an administrative fee will be charged by the Department of Health (DH) as follows:
Charges shall be paid by means specified on the overleaf of the General Demand Note.
The Requested Data will be sent to the correspondence address provided in the online Data Access Request (DAR) form according to the preferred manner (by a registered / an ordinary mail) stated in Part V upon receiving the payment. If the payment is not settled 28 days after the General Demand Note was issued, the Requested Data will be disposed of by the Centralised Organ Donation Register (CODR) Office without further notice. If access to the concerned data is needed in the future, a new application is required.
DH shall respond to a data access request in writing even if we do not hold the requested personal data.
If the Requestor needs to submit the DAR form in paper format, it shall be completed either in Chinese or English and be submitted to the CODR Office of DH:
DH is required to take all reasonably practicable steps to ensure that personal data held by us are protected against unauthorised access. For applications submitted by post, the Requestor needs to include a proof of identity together with the completed DAR form in paper format. For applications submitted in person, the Requestor needs to provide a Hong Kong Identity Card for identity verification. Failure to provide the information as required by DH may result in the data access request being refused or not being complied with to the desired extent.
